Trump administration appeals Portland Guard deployment ruling

Driving the news: U.S. District Court Judge Karin Immergut, appointed by Trump in 2019, was blunt in her assessment of the government's evidence that National Guard troops were needed to enforce the law in Portland.

• Trump's description of Portland as "war ravaged" was "was simply untethered to the facts," Immergut wrote in a 31-page opinion.

State of play: Local officials — who had railed against the potential deployment of troops as unnecessary and dangerous — celebrated the ruling.

• "The President must demonstrate an actual threat based on real facts if he wants to put the National Guard on our streets," Oregon Attorney General Dan Rayfield said in a statement.
• "Members of the Oregon National Guard are not a tool for him to use in his political theater," Rayfield said.

The other side: Within hours, lawyers with the U.S. Department of Justice filed a notice of appeal to the 9th U.S. Circuit Court of Appeals.

• "President Trump exercised his lawful authority to protect federal assets and personnel in Portland following violent riots and attacks on law enforcement," White House spokesperson Abigail Jackson said, per the Oregonian.

• "We expect to be vindicated by a higher court."

The latest: Crowds of protesters grew at the ICE facility over the weekend, with hundreds gathering outside the building in South Portland on Saturday, per OPB.

• Federal agents fired off tear gas canisters, flash bang grenades and pepper balls after demonstrators blocked the road in front of the facility.

What's next: It remains unclear how quickly the 9th Circuit will rule on the government's appeal.

• The temporary restraining order expires Oct. 18, unless lawyers for the city and state seek to extend it.
