New bill could give Californians more power to sue feds

Zoom in: Wiener, who is vying for Nancy Pelosi's congressional seat, said Tuesday during a press conference that "it's almost impossible" to sue federal agents for damages under federal law due to Supreme Court rulings that have narrowed people's ability to bring constitutional claims against federal officers.

• SB 747, or the "No Kings Act," would expand California's 1987 Tom Bane Civil Rights Act to cover any constitutional right violation — not just those involving threats, intimidation or coercion.
• The proposal would allow California residents to sue any local, state or federal law enforcement agents and officers for violations such as unlawful home searches, interfering with the exercise of religion or freedom of the press, retaliation for protected speech, excessive use of force at protests or enforcement based on national origin, political affiliation or race.
• Individuals could seek monetary damages in state court if a judge finds their constitutional rights were violated.

What they're saying: "This bill reinforces a foundational principle that the Constitution protects all people on California soil — regardless of their immigration status, their nationality or the agency of the officers standing in front of them," Wiener said.

The big picture: The measure builds on Wiener's earlier efforts, including the recently passed SB 627, which bans law enforcement from wearing masks or hiding their identities during operations. The law, set to take effect Jan. 1, is currently being challenged in federal court.

What we're watching: While the bill is certain to face a legal challenge if signed into law, Wiener said he's confident it could hold up in court.
