Five Below must pay Michigan over alleged pricing violations

Catch up quick: In 2025, state inspectors found 20 Five Below stores weren't following pricing rules on 30 different occasions.

• They saw items labeled as $5 rung up for $6 or $7, with scanners overcharging and prices not clearly displayed, according to a news release.

What they're saying: "Michigan consumers must be able to trust that the prices they see on the shelves match what they are actually being charged," Nessel said in the release. "This agreement holds Five Below to a high standard of accountability and ensures they take concrete steps to improve their business practices moving forward."

Context: Inspectors in the Michigan Department of Agriculture and Rural Development's Weights and Measures program ensure retailers charge fair and transparent prices, under the state's Michigan Shopping Reform and Modernization Act and the Michigan Consumer Protection Act.

What's next: Five Below is expected to audit its prices internally.

• An independent auditor will also look at its prices four times over the next year, and impose penalties if there are any more violations.
