Trump lawsuit against entire Maryland federal court tossed out

• "As much as the executive fights the characterization, a lawsuit by the executive branch of government against the judicial branch for the exercise of judicial power is not ordinary," wrote Thomas T. Cullen, U.S. district judge for the Western District of Virginia.

• The lawsuit came over an order from Chief Judge George L. Russell III and others that bars the government from immediately deporting people contesting their detention.
• The lawsuit was filed amid the Trump administration's wrongful deportation of Kilmar Abrego Garcia to El Salvador.
• In their complaint, the Justice Department attorneys pointed out the influx of injunctions over the administration's policies and described the order as "a particularly egregious example of judicial overreach."

Driving the news: "Any fair reading of the legal authorities cited by defendants leads to the ineluctable conclusion that this court has no alternative but to dismiss," Cullen wrote.

• "To hold otherwise would run counter to overwhelming precedent, depart from longstanding constitutional tradition, and offend the rule of law."
• Judge Cullen also called out the Trump administration's effort to "smear and impugn individual judges," saying it is "both unprecedented and unfortunate."
