Jack Smith asks court to pause Trump classified docs case appeal

• The language used in the filing to the 11th Circuit Court of Appeals in Miami is similar to that when he asked to pause proceedings in Trump's federal Jan. 6 case, which a judge granted last week.

State of play: The court was reviewing a decision to dismiss the case by Judge Aileen Cannon in July, who ruled that Smith had been unlawfully appointed.

• Smith said in Wednesday's filing that "as a result of the election" the government "respectfully requests that the Court hold this appeal" until Dec. 2 "to assess this unprecedented circumstance and determine the appropriate course going forward consistent with Department of Justice policy."
• The filing said that the defense did not object to Smith's request.
• Smith has been in discussions with Justice Department officials about how to close his federal criminal cases against Trump.

Meanwhile, the New York judge overseeing Trump's criminal hush money case on Tuesday granted a request by the defense and prosecution to pause the case in light of his election win.
