Unions sue Trump over surveillance and allege First Amendment breach

What's inside: The lawsuit, alleging First Amendment breaches, targets the State Department's "Catch and Revoke" program, which "includes AI-assisted reviews of tens of thousands of student visa holders' social media accounts."

• The Electric Frontier Foundation represented the United Automobile Workers, the Communication Workers of America and the American Federation of Teachers in the suit.
• The suit also requests the removal of all records created and stored by the administration's surveillance program.

State of play: At the start of his second term, Trump signed an executive order targeting visa holders who "bear hostile attitudes" or back foreign terrorists and "threats to national security."

• Hundreds of college students and recent graduates had their visas revoked in April, largely for supporting pro-Palestinian protests.
• The assassination of Turning Point USA co-founder Charlie Kirk in September initiated a new round of crackdowns, with Secretary of State Marco Rubio threatening to revoke visas of those who celebrated his death.
• The State Department revoked the visas of six non-U.S. citizens earlier this week for glorifying the death of Kirk.

What they're saying: "The government is using the threat of immigration enforcement to suppress dissent," the lawsuit reads.

• "This lawsuit seeks to enjoin an interagency federal program designed and executed primarily to surveil, intimidate, and silence noncitizens lawfully present in the United States who express views that the government disfavors."

The other side: "President Trump and his administration have the constitutional authority to promote and protect the foreign affairs and national security interests of the United States, including through visa programs," White House spokesperson Anna Kelly told Axios.

• "Foreigners who pose a threat to these interests will not be welcomed into our country."
• Representatives for the State Department did not immediately respond to Axios' request for comment.
