Biden administration touts border efforts with extended asylum restrictions

Context: An interim rule launched in June was meant to "temporarily suspend the entry of certain noncitizens across the Southern border," according to the Department of Homeland Security.

• The rule makes noncitizens ineligible for asylum while border encounters are at high levels, with some exceptions.

By the numbers: 119,000 of 121,000 people removed or returned since the interim proclamation went into effect were specifically processed under the interim rule, senior officials said Monday.

• Average daily encounters are at their lowest point in four years with a seven-day average of 1,800 encounters per day.
• Encounters between points of entry have decreased by more than 55%.

State of play: The final rule going into effect Tuesday continues to restrict asylum eligibility.

• However, those measures will be discontinued after the seven-day average for encounters is under 1,500 per day for 28 consecutive calendar days.
• Unaccompanied children from noncontiguous countries will now be included in the calculation of encounters — a change from the interim rule.

Zoom in: Unaccompanied children, lawful permanent residents, victims of severe trafficking and non-citizens with valid visas or other lawful permission are exempted from the proclamation and final rule.
