Judge keeps Biden's latest student loan forgiveness plan blocked

Zoom in: U.S. District Judge Randal Hall extended a temporary restraining order for an additional 14 days from Thursday in order to allow the court time to review and assess the case, per court documents.

• Hall had originally issued the order on Sept. 5, after Republican attorneys general in seven states filed a lawsuit in an attempt to block the latest student loan forgiveness proposal.
• They argued the plan, unveiled in the spring, is illegal.
• The White House and Department of Education did not immediately respond to Axios' request for comment.

Context: Biden's new plan, which would not require an application, would provide relief for more than 30 million borrowers and include a provision to cancel up to $20,000 of a borrower's accrued interest.

Zoom out: The Department of Education is meanwhile awaiting a final decision on its SAVE Plan and other income-driven repayment programs after a federal court injunction prevented their implementation.

• Biden's new plan, as well as the SAVE Plan, came after the Supreme Court blocked the president's signature student loan forgiveness plan last year.
• The administration has still found ways to circumvent the need for Congressional or court approval and provide more than $168 billion in relief for more than 4.7 million borrowers.
