Ohio Attorney General Dave Yost. Photo: Justin Merriman/Getty Images

Ohio Attorney General Dave Yost filed a lawsuit against the Biden administration Monday over a Trump-era ban on abortion referrals that President Biden overturned earlier this month.

The big picture: The lawsuit aims to reinstate two measures included in the 2019 legislation that required federally funded family planning clinics to be "financially independent of abortion clinics," and refrain from referring patients for abortions.

  • Yost alleged that Biden had broken federal law by reversing the ban on abortion referrals, saying, "Federal law prohibits taxpayer funding of abortion — and that law means means nothing if the federal money isn't kept separate."
  • The action filed by Ohio's Republican attorney general was joined by 11 other states, per the release.

Flashback: Former President Trump issued the rule in 2018 to appeal to his anti-abortion base, Axios' Shawna Chen writes.

  • The Biden administration revoked the ban earlier this month, issuing a revision that allows health clinics to receive the Title X federal family planning funds, even if they make abortion referrals.

SCOTUS' ruling on Mississippi abortion case could impact Pennsylvania

Abortion will remain legal in Pennsylvania, up to about 24 weeks, if the U.S. Supreme Court overturns Roe v. Wade. But protections are still vulnerable.

Driving the news: The nation's high court heard oral arguments Wednesday in Dobbs v. Jackson Women's Health Organization, a case over Mississippi's law banning abortion after 15 weeks of pregnancy.

What the Supreme Court ruling on abortion could mean for Minnesota

Abortion will remain legal in Minnesota if the U.S. Supreme Court overturns or significantly curtails Roe v. Wade, though such a ruling could eventually impact access in the state.

Driving the news: The nation's high court hears oral arguments Wednesday in a case involving a Mississippi law that would ban most abortions after 15 weeks of pregnancy.

  • Mississippi's attorney general has asked justices to overturn the 1973 ruling, which set a precedent for the constitutional right to abortion, and subsequent decisions.

Advocates see "opportunity" in abortion fight to galvanize Democratic voters

Abortion rights advocates believe the Supreme Court fight over Mississippi's strict abortion bill has the potential to turn the political script: galvanize Democratic voters, instead of its historic ability to drive turnout among Republicans.

What they're saying: "The opportunity is that people are enraged," Alexis McGill Johnson, president of Planned Parenthood, told Axios in an interview. "What we saw in Texas, and what people will walk away from [the Mississippi oral arguments with], is a level of rage that we could be living in a world six months from now — where our children have fewer rights than we have right now."
