Grand jury declines second attempt to indict Letitia James

• The DOJ could seek a third indictment against James.

What they're saying: "As I have said from the start, the charges against me are baseless. It is time for this unchecked weaponization of our justice system to stop," James said in a statement shared with Axios.

• "I am grateful to the members of the grand jury and humbled by the support I have received from across the country," she added. "I will continue to do my job standing up for the rule of law and the people of New York."
• The Justice Department did not immediately respond to Axios' request for comment.

Catch up quick:  Last month, a judge threw out the cases against James and former FBI Director James Comey, whom Halligan also brought charges against.

• A federal judge wrote in an order dismissing James' case without prejudice that "all actions flowing from" Halligan's "defective appointment" are "unlawful exercises of executive power and must be set aside."
• Attorney General Pam Bondi originally vowed to "take all available legal action, including an immediate appeal."

State of play: James had adamantly denied wrongdoing, maintaining that the charges that were brought against her were "baseless" and alleging the president was weaponizing the Justice Department against his political foes.

• Her legal team argued she was targeted "as a result of the President and his officials' genuine animus towards her exercise of her constitutional and statutory rights."

Flashback: The director of the Federal Housing Finance Agency wrote a criminal referral for James in April for allegedly falsifying bank statements to receive "more favorable loan terms."

• The Trump administration fired a U.S. attorney in Virginia who would not seek an indictment against James, then installed Halligan, who had no prosecutorial experience.
