Kilmar Abrego Garcia detained again by ICE, faces deportation to Uganda

The big picture: The El Salvadoran, who was living in Maryland with his wife and children until being detained by Immigration and Customs Enforcement this March, now faces a criminal trial in addition to fighting his deportation case.

• A federal judge has said Abrego Garcia can be deported but not to his home country, El Salvador, because of the danger he would face there.
• The Trump administration had mistakenly deported him there in March, leaving him in the high-security prison known as CECOT. Abrego Garcia alleges that he was tortured there.
• When the administration was ordered to bring him back, Abrego Garcia was charged with human trafficking in a Tennessee federal court. That trial will begin in January.

What they're saying: "The only reason that they've chosen to take him into detention is to punish him, to punish him for exercising his constitutional rights," Simon Sandoval-Moshenberg, one of Abrego Garcia's attorneys, said on the steps of Baltimore's G.H. Fallon Federal Building.

• He added Abrego Garcia has a "constitutional right to fight back against being illegally deported to El Salvador, his constitutional right to speak up through his court filings on the torture and treatment that he received in El Salvador at the direct request of our government."

The other side: Homeland Security Secretary Kristi Noem confirmed Abrego Garcia's detention on X.

• "President Trump is not going to allow this illegal alien, who is an MS-13 gang member, human trafficker, serial domestic abuser, and child predator to terrorize American citizens any longer," she wrote.

The latest: Sandoval-Moshenberg said that Abrego Garcia has filed another lawsuit in federal court in Maryland to ensure he has due process in any potential third-country removal.

• "They don't have present legal authority to remove him to Uganda because he's requested a reasonable fear interview. He has the right to court proceedings," he said.
