Scoop: Warren will try to restore CFPB funding in GOP bill

• The process Senate Republicans are using to pass their "big, beautiful bill" only allows for the inclusion of budget-related items in exchange for lowering the passage threshold to 51 votes. Any provisions deemed unrelated to the budget will be excised.
• Warren plans to challenge the measure through that process, arguing Republicans aren't allowed to essentially gut an agency through the reconciliation process.
• "This is yet another outrageous attempt to shut down the CFPB and attack American consumers," Warren said in a statement to Axios.

The big picture: It will be up to Senate Parliamentarian Elizabeth MacDonough to issue a ruling on whether a the CFPB cut and other provisions of the bill can pass the "Byrd bath," named for the late Sen. Robert Byrd (D-W.Va.).

• Even if the provision is not stripped by the parliamentarian, Warren, who served as a special adviser to the CFPB during the Obama administration, plans to raise a point of order challenging it on the Senate floor, we are told. But she'd would be unlikely to get the votes needed to prevail.
• Senate Democrats plan to use the same process to try to get rid of an array of provisions in the bill, including restrictions on Medicaid coverage and immigration fees.

Zoom in: Senate Republicans are proposing a cut to the CFPB's ability to request funds from the Fed, from 12% to 0%.

• The bureau can request funds from Congress, but it is principally funded by the Fed.

Between the lines: The Trump administration has already tried to drastically cut the workforce at the CFPB, but federal courts have halted those layoffs while litigation continues.

• The CFPB has returned over $20 billion to consumers through enforcement actions since its creation in 2011.
