On Wednesday, an appeals court denied Uber's request to move Waymo's trade secret theft lawsuit into arbitration. The case is scheduled for a jury trial next month.

The court also denied an attempt by Anthony Levandowski, a former Waymo and Uber employee at the center of this case, to keep the ride-hailing company from handing over a due diligence report. The report, prepared by a forensics firm last year as part of Uber's acquisition of Levandowski's self-driving truck startup, is believed to contain incriminating evidence.

Waymo, Alphabet's self-driving car unit, filed a lawsuit in February claiming Uber company is using trade secrets Levandowski stole when he allegedly downloaded 14,000 files before leaving in January 2016. Levandowski soon after founded a company which he sold a few months later to Uber.
