International Criminal Court judges on Friday said they asked UN Secretary-General António Guterres and the ICC's governing body for assistance in identifying who represents Afghanistan at international bodies, Reuters reports.

Driving the news: The request comes after the ICC said Friday that it can't make a ruling on a request by the court's prosecutor to resume an investigation into alleged war crimes of Afghanistan.

  • "The request cannot be legally adjudicated without addressing the question of which entity actually constitutes the state authorities of Afghanistan since 15 August 2021," the ICC wrote on Friday, per Reuters.
  • The ICC asked for a determination from Guterres and the court's governing body on which group officially rules Afghanistan from an international law standpoint by Nov. 8.
  • The United Nations has not yet determined who should represent Afghanistan at the UN following the Taliban's swift takeover of the nation.

What they're saying: The judges in a written ruling wrote: "For several reasons including the fast pace of relevant developments, and the short time elapsed since they materialized, there is still a large margin of uncertainty as to the legal implications of those events, including for the purposes of international law and international relations," per AP.

Appeals court scraps order mandating COVID protections for immigrant detainees

Judges on a federal appeals court Wednesday voted 2-1 to overturn an order requiring authorities to monitor and possibly release immigrants being held at detention centers if they are at high-risk for long term COVID-19 complications, the Los Angeles Times reports.

Why it matters: In its ruling, the San Fransisco-based panel said a federal district judge overreached in 2020 when he issued a preliminary injunction requiring the monitoring. The Trump administration appealed that ruling, and Biden's Justice Department continued to argue against it when he took office.

Philippines President Rodrigo Duterte said Thursday that he assumes full responsibility for a violent war on drugs that has killed thousands of people, Reuters reported.

Why it matters: Last month the International Criminal Court (ICC) formally authorized an investigation into alleged crimes against humanity during Duterte's war on drugs.

The Centers for Disease Control and Prevention's independent advisory panel voted unanimously to recommend booster doses of Moderna and Johnson & Johnson vaccine and allow people to mix-and-match doses.

The big picture: The agency aligns with the Food and Drug Administration authorization Wednesday night which said people could switch to whichever vaccine they wanted for their booster shot.
